Welcome to P-Spot. These Terms & Conditions (the “Terms”) govern your access to and use of the P-Spot website, mobile application, and related services.
By accessing or using P-Spot, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the platform.
1. Definitions
“P-Spot”
Refers to the P-Spot platform, including its website, mobile application, services, affiliates, contractors, and technology providers.
“Host”
A person, business, property owner, strata, church, commercial operator, or organization that lists one or more parking spaces on P-Spot.
“Driver”
A person using P-Spot to locate, reserve, or pay for parking.
“Parking Space”
Any driveway, residential parking stall, commercial parking space, church parking lot, office tower parking stall, private property parking area, or other approved space listed on P-Spot.
“User Account”
An account created by a Driver or Host to access the platform.
“Services”
Any functionality provided by P-Spot including booking, payments, messaging, licence plate tools, geolocation, parking management, points/rewards systems, waitlists, subscriptions, permits, and related services.
“Third-Party Providers”
External technology or payment providers used by P-Spot including payment processors, mapping providers, licence plate recognition vendors, SMS providers, and authentication services.
2. About P-Spot
P-Spot is a peer-to-peer parking marketplace that helps connect Drivers with underused parking spaces.
P-Spot may include:
- residential driveways
- church lots
- commercial properties
- office towers
- event parking
- temporary parking
- subscription parking
- commuter parking
- and other underutilized private property.
P-Spot acts solely as a technology platform facilitating connections between Hosts and Drivers. Unless explicitly stated otherwise, P-Spot does not own, lease, operate, supervise, or insure parking spaces listed on the platform.
Hosts are solely responsible for the legality, safety, accessibility, and condition of their parking spaces.
3. Eligibility
You must be at least nineteen (19) years old to use P-Spot.
By creating an account, you confirm that:
- all information provided is accurate
- you are legally permitted to enter into agreements
- and you will comply with all applicable laws and regulations.
- P-Spot reserves the right to suspend or terminate accounts containing inaccurate, misleading, fraudulent, or incomplete information.
4. Host Responsibilities
Hosts agree that they:
- have the legal right to offer the parking space
- are responsible for complying with municipal bylaws, strata rules, leases, and property regulations
- will keep listed parking spaces reasonably safe and accessible
- will accurately represent the parking space location and availability
- and will maintain the condition of the space including snow removal where applicable.
Hosts are solely responsible for:
- signage
- permits
- insurance
- taxes
- property permissions
- and any disputes relating to their parking space.
- P-Spot does not verify ownership of every listing and makes no guarantees regarding legality or suitability.
Host Compliance & Property Authorization
Hosts are solely responsible for ensuring that they have all necessary rights, permissions, approvals, permits, and authorizations required to list and rent Parking Spaces through P-Spot.
Hosts represent and warrant that their listings comply with all applicable:
- municipal bylaws
- zoning regulations
- strata or condominium bylaws
- lease agreements
- property management rules
- insurance obligations
- and applicable laws or regulations.
- Hosts acknowledge that certain residential, strata, commercial, leased, or institutional properties may prohibit or restrict third-party parking activity.
- P-Spot does not independently verify legal compliance of listings and assumes no responsibility for unauthorized or unlawful parking listings.
Hosts agree to indemnify and hold harmless P-Spot from any claims, fines, disputes, penalties, towing claims, property disputes, regulatory enforcement actions, or damages arising from a Host’s failure to comply with applicable property or legal requirements.
5. Driver Responsibilities
Drivers agree to:
- park only in their reserved space
- respect booking times
- follow all signage and instructions
- ensure their vehicle information is accurate
- and avoid blocking driveways, sidewalks, lanes, fire routes, chargers, or accessible stalls.
Drivers may not:
- store damaged or abandoned vehicles
- use parking spaces for unlawful purposes
- conduct vehicle repairs or commercial activity
- or interfere with other users or property owners.
- Drivers are responsible for all damage caused by themselves, passengers, or their vehicles.
6. Bookings & Parking Access
All bookings must be completed through the P-Spot platform unless otherwise authorized.
Booking availability, pricing, and restrictions are determined by Hosts and may vary by location.
P-Spot may support:
- hourly bookings
- event parking
- commuter parking
- monthly subscriptions
- recurring reservations
- geofenced access
- licence plate recognition
- QR access
- and automated parking technologies.
Some locations may use automatic entry/exit systems or licence plate recognition. By using these features, you consent to automated parking session tracking and related charges.
Drivers are responsible for complying with all booking times and parking restrictions associated with the applicable Parking Space.
7. Payments
Payments are processed through third-party payment providers such as Stripe.
By using P-Spot, you authorize:
- parking charges
- subscription renewals
- penalties
- damage fees
- and applicable taxes and service fees.
- All pricing is displayed in Canadian dollars unless otherwise specified.
P-Spot may deduct:
- platform fees
- processing fees
- dispute fees
- or applicable penalties.
Pricing may vary by:
- location
- demand
- events
- time of day
- or commercial partnership arrangements.
- P-Spot reserves the right to modify pricing structures, service fees, subscription rates, and payout models at any time.
8. Cancellation Policy
Hourly / Fixed-Term Bookings
Within 10 minutes of booking: Full refund
More than 24 hours before start time: Refund minus applicable processing fees
Less than 24 hours before start time: Partial or credit-based refund
After booking start time: Non-refundable
Monthly Subscriptions
Current billing periods are non-refundable.
Future subscription periods may be cancelled according to the cancellation timelines shown within the app.
P-Spot reserves the right to modify cancellation policies for certain locations, events, or commercial partnerships.
9. Penalties, Violations & Towing
P-Spot and/or Hosts may issue penalties or arrange towing for:
- overstaying bookings
- unauthorized parking
- blocking access
- parking in restricted spaces
- fraudulent activity
- or violating these Terms.
Drivers are responsible for:
- towing costs
- storage costs
- tickets
- and administrative fees.
- Penalty amounts may vary by property and posted signage may override platform defaults.
- P-Spot reserves the right to suspend or permanently terminate accounts associated with repeated violations or fraudulent activity.
10. Licence Plate Recognition, Geolocation & Parking Technology
P-Spot may use automated technologies including licence plate recognition (“LPR”), geolocation services, QR code access systems, geofencing, cameras, automated parking timers, and related parking management technologies.
By using the Services, you expressly consent to the collection, storage, processing, and use of:
licence plate information,
vehicle identification information,
parking session data,
geolocation information,
entry and exit timestamps,
images associated with parking enforcement,
and related operational data.
This information may be used for:
- parking verification
- automated access control
- booking validation
- enforcement
- payment processing
- fraud prevention
- customer support
- analytics
- and platform security.
P-Spot may share this information with Hosts, commercial property partners, towing operators, enforcement providers, payment processors, insurers, law enforcement, or applicable authorities where reasonably necessary to operate the Services or comply with legal obligations.
Users acknowledge that certain parking locations may use continuous or automated monitoring systems and consent to such monitoring while using the Services.
11. Insurance
Drivers and Hosts are responsible for maintaining their own insurance coverage.
P-Spot does not provide automobile, property, or liability insurance unless explicitly stated in writing.
Hosts are encouraged to verify whether their homeowner, strata, or commercial insurance permits parking rentals.
12. Commercial Properties & Enterprise Partners
Certain Parking Spaces available through P-Spot may be operated by commercial property owners, office towers, retail operators, churches, institutions, municipalities, event organizers, or enterprise parking partners (“Commercial Partners”).
Commercial Partner locations may be subject to additional rules, pricing structures, operating hours, enforcement policies, towing procedures, access systems, permits, or restrictions established by the applicable Commercial Partner.
By using Parking Spaces operated by Commercial Partners, Users agree to comply with all posted signage, parking instructions, property rules, and operational requirements applicable to such locations.
P-Spot may act solely as a technology provider, payment facilitator, booking intermediary, or parking management platform for Commercial Partners and does not assume operational control over such properties unless explicitly stated otherwise.
Commercial Partners reserve the right to deny access, revoke parking privileges, issue penalties, or request towing enforcement for violations of applicable parking rules or these Terms.
13. Community Standards
Users may not:
- harass or intimidate others
- post misleading content
- impersonate another person
- use hate speech
- commit fraud
- abuse the platform
- or engage in illegal activity.
P-Spot reserves the right to:
- remove listings
- suspend accounts
- restrict access
- or cooperate with law enforcement.
14. Rewards & Points Program
P-Spot may offer points, credits, referral bonuses, or promotional rewards.
Points:
- have no cash value
- may expire
- may be modified or discontinued
- and may be revoked for fraud or abuse.
- P-Spot may partner with businesses, office towers, events, or local merchants to provide rewards or promotions.
15. Intellectual Property
All P-Spot branding, logos, software, designs, and platform content are the property of P-Spot or its licensors.
Users may not reproduce, copy, resell, reverse engineer, or commercially exploit the platform without written permission.
16. Third-Party Services
P-Spot may rely on third-party technologies and providers.
P-Spot is not responsible for outages, failures, or actions caused by:
- payment providers
- GPS systems
- mobile carriers
- mapping software
- or third-party integrations.
- Use of third-party services may also be subject to their own terms and privacy policies.
17. Privacy
Use of P-Spot is also governed by the P-Spot Privacy Policy.
By using P-Spot, you consent to:
- collection of account information
- geolocation data
- payment-related information
- licence plate data
- parking session information
- and communications required to operate the service.
18. Limitation of Liability
To the fullest extent permitted by applicable law, P-Spot, its affiliates, officers, directors, employees, contractors, technology providers, and partners shall not be liable for any indirect, incidental, consequential, exemplary, special, or punitive damages, including but not limited to loss of profits, loss of business opportunity, vehicle damage, towing costs, theft, vandalism, personal injury, loss of data, or interruption of Services.
P-Spot’s total aggregate liability arising out of or relating to the Services, any Parking Space, or these Terms shall not exceed the greater of:
(a) the total fees paid by the applicable User to P-Spot during the twelve (12) months preceding the claim; or
(b) one hundred Canadian dollars ($100 CAD).
These limitations apply regardless of the legal theory asserted and even if P-Spot has been advised of the possibility of such damages.
19. Dispute Resolution & Arbitration
In the event of any dispute, claim, or controversy arising out of or relating to the use of the P-Spot platform, Services, Parking Spaces, or these Terms, the parties agree to first attempt to resolve the matter informally by contacting P-Spot support.
If the dispute cannot be resolved informally within thirty (30) days, the dispute shall be submitted to confidential binding arbitration in the Province of British Columbia, Canada, except where prohibited by applicable law.
The arbitration shall be conducted by a single arbitrator under the rules of the applicable arbitration authority selected by P-Spot. The arbitration may occur virtually or in person in British Columbia.
You agree to waive any right to participate in a class action, class arbitration, or representative proceeding against P-Spot to the fullest extent permitted by law.
Nothing in this section prevents P-Spot from seeking injunctive relief, collection remedies, towing enforcement, intellectual property protection, or equitable remedies in a court of competent jurisdiction.
20. Force Majeure
P-Spot is not liable for delays, outages, or failures caused by events outside reasonable control including:
severe weather,
government actions,
internet outages,
strikes,
emergencies,
or property access issues.
21. Modifications
P-Spot may update these Terms at any time.
Continued use of the platform after updates constitutes acceptance of the revised Terms.
22. Governing Law
These Terms and any dispute arising out of or relating to the P-Spot platform, website, mobile application, or Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the courts located in British Columbia, Canada, and you hereby attorn to the exclusive jurisdiction of such courts.
